copy of the letter of the 4th April referred to therein. It should be noted that, in this letter of April 4th, Madame Kupsch whose maiden name was Guignard, is inadvertently referred to as Madame Guignard throughout. A copy of Mr. Garstin's reply is also attached.

You will observe from this correspondence

that Mr. Garstin recommends the release of the funds in question on the ground that Madame Kupsch and her children are in extremely necessitous circumstances and that her intention to resume French nationality is gemine. The objections, largely technical, to Madame Kupsch's claim are set out in the Custodian's letter of the 4th April.

In the circumstances I strongly recommend that the funds which consist of 13 shares on the Shanghai Register of the Hongkong and Shanghai Bank be released in favour of Madame Kupsch and her children on condition that she takes out through the British Court at Shanghai the necessary letters of administration in respect of the estate of her late husband. The sterling value of the shares with accrued interest and certain rights in respect of a new

capital issue would amount at present exchange to about

£3,000. Os. Od.

As the status of the shares on the Shanghai

Register has not yet been definitely decided it will be

necessary, should you consent to the release of the funds,

to secure the concurrence of His Majesty's Minister at

Peking. I am forwarding a copy of this despatch to him,

and I have no doubt that his concurrence will be forthcoming

if you agree.
